THE STORY:

My divorce was finalized September 22, 2015. I now have joint custody of my three-year-old son (even split of 50/50). I was granted major decision-making rights for my son, including medical, educational, religious, and travel decisions. Both before the final decree and since that time, I have not been included in major decisions and am often either not informed of visits until after they occur or sometimes not informed at all. Very few, if any, visits have been scheduled after conferring with me. My son has significant speech delays and receives speech therapy through the local school district. He is on his fourth therapist since August 2015, and until his current therapist, I have had little communication with his service providers and frequently have to request direct communication from them. Most of my information is through my son's daycare providers. His father is now suing for sole custody, stating that I have not been involved enough in my son's therapy. Since his weekly appointments began in August, his father has attended two speech therapy sessions. I have been to all but a small handful. At these appointments, I learn techniques to practice at home with my son. His current therapist gives homework assignments and logs to track his progress. In the last nearly three months, his father has not done the homework or logs and frequently fails to return the folder with assignments and log sheets. There is no history of abuse or neglect on my side. Before the divorce, I was a stay-at-home mom. I have struggled with homelessness and unemployment in the last two years, and much of my money has gone toward legal fees and medical bills for a still undiagnosed condition that caused all of my hair to fall out postpartum, in addition to postpartum depression, extreme fatigue, and severe eczema that led to a rare case of a viral infection that almost resulted in vision loss. This is in addition to unexpected car repairs and the expense of commuting 45 minutes one-way to get to my son's daycare. I am finally making headway toward permanent housing and employment, but once again have to funnel money into attorney's fees instead of permanent housing. I have a stable and safe home for now and a very supportive network of friends and solid church family. I have ample documentation to refute the claims being made, and sole custody is rarely awarded in my state. Legal Aid will not take my case because there is already a large backlog, and they will not get involved unless there has been physical abuse. I have a very good attorney who is honest, realistic, and wise in approach and use of time and money. She specializes in family law. My ex's attorney just does general practice and does not offer reasonable counsel. He often acts without informing his attorney and has violated the custody order and taken my son several times to deny me parenting time. When he first filed for divorce, he kidnapped my son for several months -- a direct violation of state statute (Missouri 565.153). Unfortunately, this statute is seldom prosecuted. I am currently working full-time and doing tutoring and housecleaning gigs on the side to keep going, but I need all the help I can get. I do not have family to help.
