A parent's worst nightmare.
The story in a nutshell:
As a parent I can't imagine not being able to tuck my children into bed, get them ready for school, or all the little daily things we so often take for granted; let alone lose that natural right for no reason other than an angry ex-husband who has a position of power in a small town, so he is able to manipulate a deeply flawed court system. But this is exactly what has happened to my friend, Jane.
Jane is a loving mother of two children, has been a dedicated teacher for 15 years, is a longstanding member of her church and committed to serving her community, has been approved to be a foster parent, and is a passionate animal rights advocate, but her son was taken from her based on false allegations made by her scorned and very angry ex-husband who holds a position of power in a small town.
The courts required no evidence to back his claims and dismissed the evidence she presented that directly refuted his false allegations and moved to take her son from the only caregiver he has ever really known.
Jane is fighting to get her son back, but needs our help to raise money for attorneys fee's to support this fight.
The full story:
Jane is going through a very nasty divorce from a man that was abusive and violent, they have an almost 2 year old little boy, Jaiden. Her ex-husband has stated that his intent is to "destroy" her through family courts and filed for custody in retaliation for my friend filing for child support. My friend's ex-husband walked out on her and her son at the hospital when Jaiden was born and remained estranged for almost the entire first year of Jaiden’s life. Jane supported Jaiden for the first year with very little help from his father and he had only seen the baby 5 or 6 times before the baby was about 8 months old.
The father was notified that the child support case was opened and the NEXT day he went down and filed for full custody stating my friend was an unfit parent. No claims regarding her parenting had been made until she filed for child support. They fought this out in the courts for months when the father was given 2-3 overnights a week, despite his documented anger issues and police reports and past convictions for his anger.
About a month into the increased visitation the baby came home with a hand print shaped bruised on his lower back and a bruised welt along his side. The mother took the child to the Dr and the Dr called CPS. CPS substantiated that the injuries happened while the child was in the fathers care but told my friend she had to go back to family courts to get the visitation modified. So Jane went back to court and was told they weren't going to modify visitation but would send her back to mediation.
They went back to mediation and Jane requested separate mediation. She met with the mediator first. She went in and gave the mediator the CPS info and Dr info and talked to the mediator about past allegation the ex-husband had made that had been disproven along the way. Jane left and her ex-husband met with the mediator the next day.
The ex-husband told the mediator that my friend Jane was crazy and that the CPS allegations had been closed as unfounded (the mediator had the letter saying it had in face been substantiated) and that Jane was a horrible mother and their son was fearful of her. With no evidence to support any of the ex-husbands claims the mediator recommended that Janes son be taken from her care and the ex-husband have full legal and physical custody. The mediator had no evidence, there has never been any kind of diagnosis or mental health incidents in Jane's history at all.
There are many people who wrote letters in support of Jane's character and parenting ability. Jane got a letter from an MFT addressing er ex husbands allegations and stating that there was NO evidence that any of his allegations were true and asked the court to reconsider its recommendations in consideration of the negative effect removing a child from its primary caregiver will have on Jaiden's attachment, she got a letter from the child’s daycare stating that the child is well adjusted, thriving in mom's care, and ALWAYS happy to see mom at the end of the day, she also got a letter of support from her employer citing her reliable performance and interactions with her students that would make his claims of mental health issues impossible, as well as Dr.’s notes that directly refute the lies the ex-husband told the mediator.
They still took her son.
Jaiden is two. She is the only caregiver he has known. He spent maybe 30 overnights throughout his entire life with his father before they gave Jaiden to the father. The baby is now with an angry, violent man who has a substantiated CPS report against him. Jane is heartbroken and terrified for her son. This isn't supposed to happen in our court system.
Jane has requested a trial and is fighting this, and will continue to fight, but she needs help raising the money for attorney’s fees and now for further professional evaluations (even though there was never any evidence or diagnosis that ever said there was a problem with her ability to cae for her son). She has already spent a lot in attorney’s fees and the first thing the father did was file for child support, within the week of Jaiden being ripped away from Jane.
Jane is a woman that unfailingly helps anybody in need, I get to see it every day with the students who's lives she enriches and the love she shows all of us, and she never asks for help herself, but right now she needs our help. Her son needs our help.
Please stand with Jane against this egregious injustice and help her fight for her son. Every little bit helps and please share!
TLDR? My friend lost her son because her ex has power and influence, even though he is violent and left them when the baby was born, he said he would ruin her, now he is trying. Help her raise money for court!
