Lost my land and home of 23yrs...
Organized by: Melinda Berry
Will you help me... please...? I am retired and after making my home of 23yrs on a piece of land my parent verbally gave me back in ]1993, recently have been told by local Chancery court, that since my other siblings now want to sell, i will need to move and just give all the enhancements I put on this land, as part of the decease parent's Estate. Give there is a Will that stated back in 1985, that all siblings to get an equal share of all. This including what i]ve put on part of this Estate and have lived all these years. While the parent's intent should have been well known, given the about of time and enhancements i'd done..., it was never put in writing. Our mother past in '2013, after our father who passed in '2005. Because only a verbal was given to me and even though mother also verbally told older siblings, that I was to keep the 3/4ac piece of property i was on, the siblings are selling all without agreement of any "mini sub divide" or, In lieu of partion. I am at a stage where i was not prepared for this and me and my disabled 29yr old son are litterally being put in the street. The 2.3ac Estate will sell for an Auction price now, due to older siblings taking this matter to court. Once sold i will have a short period to vacate the land. This land which was left from my maternal grandmother, to my mother, who gave me a piece. The legacy of the land is also noted in addition, to the family roots in the community. Trying to get over all this when mother's verbal given to siblings on dying bed was not honored isn't easy. Mother told them not to be arguing over the land and i was to keep the piece i'd lived on so many years, as my share. I out of a number of siblings made my home on the Parent estate, they all had a chance as were much older siblings apart from myself, who grew up six years after all other siblings i came along... They exited to start own lives when they come of age, but I remained on the parent's Estate grounds and stayed in Delaware. I was close and assisted daily with both aging parents, till their deaths. Yet there was no fair compromise give from siblings at court, only that per their attorney, i have a chance to purchase the entire Estate, This would now be the only way I would be able to keep the piece I've live on so many years and upgraded... . ... I know this sort of thing happens to people but when it happens to you, it is holy hell to go through not to mention fees i had to pay for lawyer to respond to the sibling's initiated petition. i have paid for costly enhancements on this property that took years of loan payments and to be told court decsision is i give all as one property and only entitled to an equal share, is what i have to accept. That or pay more legal battles trying to get siblings to pay for my enhancements. Once the Estate sells the court is to distribute the money, so hopefully some compensation will be for my enhancements but i don't hold my breath since this whole matter is "unfair". Thirty thousand easy in enhancements/upgrades to land i paid for during State worker tenure only to get to court outcome of i have to give it and move. ie/Paid for a septic, well, electric hook ups, chain link fence surrounding 3/4 ac, mobile home with shed etc..., told i'll just have to move. Of course as you can imagine, none of the siblings have asked if i need down payment money to help my disabled son and I relocate or even considered having us both, until we were relocated. Further noted is that all the older siblings have established their own homes, some have kids who have homes and so they really don't need to sell our parents legacy at this point and for Sheriff auction sale rates. But they want their money so that's more important than baby sister being homeless... My goal is to own a home but currently have no closing cost funds. Even though i am close to getting a mortage pre -approval, was told I will still need that as well as start up fees and furnishings for this unexpected move So, If anyone can..., your assistance is very much needed and would be very much appreciated. I would like to eventually get a single family home, for my family (3bd rm 1.5ba with basement). Trying to stay in Delaware Kent co area. I have a zero turn lawn mower, as am use to having a yard and grass to cut. Any assistance with needed funds to help us relocate? Thank God for these web sites there may be somebody out there who can help. Respond to web site: firstname.lastname@example.org Sincerely Ms B.
