I was arrested in Beinville Parish in February 2016, under the false complaint of Reckless Discharge of a Firearm (a Misdemeanor), (at which time I willingly surrendered my handgun as evidence, since it had not been fired, and offered repeatedly to submit to a GSR test, each time I was refused), there was no evidence to support the charge, since it didn't happen. Before I could finish bonding out, after it was determined that I could bond out, the charge was upgraded to Aggravated Assault with a Firearm (a Felony), again, with no evidence other than conflicting witness statements. At my arraignment I was offered a "deal" by the ADA assigned the case, in which, in exchange for pleading guilty, they guaranteed I would ONLY serve six months in prison, and then be placed on probation for two years. I said no, when my case was called before the judge, the ADA informed the judge he was pursuing 5 counts of Aggravated Assault with a Firearm (5 Felonies), again with no supporting evidence. I took out a loan in February (that I couldn't afford) to hire a lawyer, who has repeatedly failed to represent me properly, failed to file the proper motions to have the case dismissed, or to fight the continuances the ADA has repeatedly asked for in order to stall. In addition, I have been unable to reach my lawyer in two weeks. Finding out earlier this week, his office has been vacant for at least a month, and his office phone has been disconnected. On 5Oct2016 the ADA sent a Subpoena to my lawyer notifying him that we were ordered to a plea date, my lawyer failed to notify me (the DA's office failed to notify me), and my lawyer failed to appear, resulting in a bench warrant and bond forfeiture being issued against me, because of which I have been unable to work, without risking being taken back into custody, and being unable to afford to re-bond. I am about to lose my job, my home, and everything I have spent the passed 20+ years earning. On 17Oct2016 the DA's office issued a Subpoena to my lawyer (and again failed to Subpoena me), ordering us to appear at 1:30pm, but set the case on the docket for 9:30am, after which both the Bench Warrant, and Bond Forfeiture were upheld, and my lawyer has since failed to file a motion to have the Warrant or the Bond Forfeiture rescinded based on the evidence of the Subpoena. Which means I am still unable to go back to work. I started this GoFundMe in order to raise the funds to hire a lawyer to help me, one that will actually do his/her job, and not leave me clueless, financially broke, and at the mercy of Beinville Parish's unethical, and unconstitutional, practices.
