In November 2013 Federal National Mortgage Associates brought a wrongfull foreclosure lawsuit, through their attorneys Doonan, Graves & Longoria, against my husband who is a disable veteran. This can be confirmed by looking up Federal National Mortgage Association vs. Moffat A.C. Gardner in the Superior Court Penobscott, Maine Doc NO. 2013-139 filed November 8, 2013.

Trouble is that my husband never owned the property they are suing him for in relationship to the back mortgage payments. Their case is based on the fact that because he was named after a family member then he is responsible for the paying the mortgage on the property.

The truth is when that family member died they willed the property to their daughter, who has not made the mortgage payments.

We have provided tons, what seems like, of documents showing that are suing the wrong person and should go after the daughter in this case; but they refuse to do so. Some of documents that have been provided to the attorneys have been the Last Will & Testament and Original Trust with copies of the 3 Amendments. In all of the document it showed the that daughter inherited the property and not my husband. Still the mortgage company is going after my husband.

The result is that he has had to go to Bangor, Maine; from our home in Arizona, 2 different times just to defend himslf in court. An 2 times the case has been delayed by some legal maneuver on the part of mortgage companys attorneys. Now we are faced with a 3 trial date, to be determine, after August 2014.

All this legal maneuvering has cost us over $49,000.00 dollars so far, which we did notvhave since we are both retired and living on a fix income from our disability and social security. Yet, if we do not fight this mortgage company and their big time lawyers we will have pay them back mortgage payments over $120,000.00, attorney fees, legal cost (still to be dertmined) for something we never owned.

We are tapped out ourselves finanically. Our little nest egg of money is gone, we have taken out a 2nd mortgage on our home in Arizona, and gotten a little help from family and friends which we cannot ever repay full. Still we are faced with more trials and legal battles ahead. Therefore, we are faced with going outside our resources and ask others if they will help!!!!!

If we do come up with additional funds soon to pay our attorneys, no lawyer is cheap, then they will stop representing us in this case. Can you, will you HELP!!!!!
