The Supreme Court will announce today its decision on whether it will hear the appeal to determine whether California’s Proposition 8 is constitutional. Proposition 8 is a 2008 California ballot initiative that amended the California Constitution to state that "only marriage between a man and a woman is valid or recognized in California.” An organization of California voters put Proposition 8 on the ballot in response to a California Supreme Court decision that struck down two California laws defining marriage as a relationship between a man and a woman, declaring them unconstitutional. California voters disagreed with the California Supreme Court’s decision and passed Proposition 8 by a substantial margin. But then, after a federal lawsuit was filed in San Francisco, a federal district court judge and a panel of appellate judges, including the most liberal judge in the United States, held that Proposition 8 was unconstitutional.
