As you are probably aware, an out of town developer, Ben Salisbury, has submitted an application for upzoning of 110 acres of undeveloped land to increase the number of homes to exceed the maximum of 22 currently allowed. Changing this property to higher-density housing will all but destroy the last remaining open space in Big Tujunga Wash.
An Environmental Impact Report (EIR) is currently being generated to mitigate any negative effects that would occur. Stakeholders get a chance to provide public comments on this EIR, especially pertaining to the validity of proposed mitigation measures.
It is our EIR comments that can serve as legal grounds for challenging in court the validity of the EIR and project. Therefore, it is critical that our Response to the EIR is documented in a way that will facilitate a legal challenge if necessary.
Save Our Canyon has been searching for a lawyer to help us with this effort. We have recently found a lawyer from Shadow Hills, Dean Walruff, who owns the firm Advocates for the Environment, www.aenv.org. AENV is a public interest law firm and advocacy organization. Dean's client list includes the Sierra Club among others, and the first thing he has done is to set up a meeting between our groups at the end of April to solicit a letter of support from the Sierra Club for our cause!
The $2200 we're trying to raise will be spent as follows: 1) $2000 for legal fees including the generation of our EIR comments letter, and 2) the remainder to outreach and promotional material to help our cause.
