The Old Man and The Tiny House
Organized by: Richard Brais
Hello and peace. My name is Rick. I am 63 years old, in a forced retirement, with Social Security as my only income. I would consider myself to be a family man. My female partner left me 23 years ago and I had the opportunity to raise my 3 children. My youngest child, my daughter Richelle, has given me 2 of my 3 grandchildren. I consider my 1st grandchild, my grand daughter Manelle, a shining star. Manelle EXPLODED in to this world. Her bowel burst while she was still in the womb and she was surgically removed and repaired. Manelle has Short Bowel Syndrome. A father could not be any more proud of their child than I was of my daughter. The 1st 16 months of Manelle's life were spent at Joe DiMaggio Childrens Hospital. (www.jdch.com) Manelle had over 10 surgeries. A couple of those were pretty stressful. We did not know if Manelle would live. Manelle is now 9 years old and doing as well as can be expected. She won a trophy for outstanding achievement and she made the A Honor Roll in a very trepidacious 3rd grade school year. My grand daughter's condition led me down many new paths. The greatest concern for Manelle was her diet. Everything that she ate went right straight through her. Therefore, to retain what little nutrients her gut would extract, I had to make sure that those nutrients were the best. I researched the internet and found so much help it was unbelievable. Manelle needed a diet high in protein. One source is eggs. I had my doubts about eggs that you buy at the grocery chain store. I decided it would be best to raise my own chickens and grow my own food. I truly believe that it is better to give than it is to receive. Giving can be as simple as a warm smile. My garden is in the front yard. No fence. I enjoy it when people come and help themselves. I give away potted plants, eggs, fruits, vegetables, and herbs to all of my neighbors. They will miss me when I'm gone. And go, I must. Sad to say that this world, my world is being changed by the FRAUDULENT system of an out of control banking cartel. May 20, 2015 is the day that Judge Lynn Rosenthal took my house. I have been in foreclosure since September of 2010. This culminated on May 20th when I appeared before the Judge and I read a prepared statement: On September 26th 2009 my life changed. I read my email that morning and found that the mortgage on my home could be fraudulent. Two articles that caught my attention were written by Dr. Gary North (Gary North's Tip of The Week - Mortgage Bonus - 9-26-2009) and Dr. Ellen Brown http://www.globalresearch.ca/landmark-decision-massive-relief-for-homeowners-and-trouble-for-the-banks/15 They talked about a Kansas Supreme Court case: Landmark Bank v. Kessler, 2009 Kan Lexis 834. The Kansas Supreme Court held that a nominee company called Mortgage Electronic Registration System (MERS) has no right or standing to bring an action for foreclosure. MERS WAS CLEARLY SEEN ON ALL OF MY DOCUMENTATION. Further research lead me to 4closurefraud.com which was sponsored by the attorney that I retained for my legal services, Carol Asbury of Save My Home law group. Carol Asbury was arrested and convicted in a real estate scam. Before going to jail, Save My Home law group did file a response to the foreclosure summons that I received on 9-15-2010. My attorney requested chain of title. The Plaintiff's attorney responded by asking for a time extension. That was in 2010. Joanne Hennessey acquired Carol Asbury's clients and I received a letter from Ms. Hennessey informing me of the change. I decided not to retain Joanne Hennessey because of her connection to Carol Asbury. I requested via email that Ms. Hennessey return all of my documents. Her response was a letter, presented to the court, withdrawing from my case. She then filed a lien for money owed to her. I never met Joanne Hennessey. I was now without a lawyer and documentation. My due diligence lead me down several dead ends. I decided to try defending myself. I was waiting for the chain of title. I was waiting for my time in court. I was waiting. I did some extended research. I discovered a book by Dave Krieger entitled "Clouded Titles" (http://cloudedtitles.com/ ) I thought that Dave's work was exactly what I was involved in. I emailed Dave about my situation. He responded telling me, basically, to give up. He told me that I did not have enough money to hire the team of attorneys required. He said that I would need forensic auditing and a team of legal analysts to look at the chain of title. 10 -15K. I would like to finish the prepared statement that I read before Judge Rosenthal on 5-20-15: Your Honor, I have been in my home for 28 years. I have waited 5 years for this time in court. In August 2014 I had a serious truck accident. I blacked out and hit a fire hydrant. This incident put me out of a job and dependent solely upon my Social Security. All the hospital tests could determine was a high chlorine toxicity level in my system. I owned my own pool service business for 30 years. I blacked out a second time and woke up in the emergency room on new years eve. Happy New Year! On new years day I was told that the blackouts were seizures. I am on medication. The cost for 4 days in the hospital, after the accident was $68,000 after what State Farm covered. The cost for 2 days to celebrate new years in the ICU was $41,000 I had no insurance. My daughter and 2 grandchildren returned home to care for me. They are still with me now. I came to these proceedings today to ask the court for 1 year to vacate the premises. Your Honor, For my entire life I have assumed that the American justice system was put in place to get to the truth. Thank You. With that, Judge Rosenthal smiled and gave me until 8-18-15, at which time my house goes up for auction. There has never been a lower point in my life, financially, than there is now. I will come out of this situation stronger. I am confident. I would love to come out of this situation and still be living in my home. Especially, since it was taken fraudulently. "Educated" people know this and are apathetic to lend a hand or speak out for fear of monetary retaliation. Fighting a banking cartel is not very easy or cheap. Please help and donate what you can. I am having a rather difficult time dealing with the fact of losing my house and especially my garden because of these circumstances.
